Supplemental Terms & Conditions for the Pipefy Community

Welcome to the Pipefy Community (“Community”). You agree that by accessing the Community you agree to and are bound to these Supplemental Terms and Conditions and the Terms and Conditions found at https://www.pipefy.com/legal-portal/terms-and-conditions/ (officially titled “Pipefy Solution Terms of Use,” and referred to herein as the “Master Subscription Agreement”), as well as Pipefy’s privacy policy found at https://www.pipefy.com/legal-portal/privacy-policy/, Data Protection Agreement (DPA) found at https://www.pipefy.com/legal-portal/annex-i-data-protection-agreement/, and Subprocessors list found at https://www.pipefy.com/legal-portal/sub- processors/. The Community is a part of the Services as defined in the Master Subscription Agreement. By accessing the Community, you agree to these Supplemental Terms, which complement the Master Subscription Agreement, where applicable. There are no fees charged for Community-related Services. Pipefy reserves the right to change these Terms at any time. For material changes, Pipefy will provide at least 30 days’ notice via email or an in-platform banner before the changes take effect; your continued use of the Community after that period constitutes acceptance of the updated Terms. 1. Community Use The Community contains a communication forum designed to enable you to communicate about the resolution of issues regarding Pipefy products and services. You agree to use the Community only to post, send, and receive messages and material that are appropriate and related to the purpose of the Community. You agree that, when using the Community, you will not use or attempt to use the Community for any fraudulent, unlawful, harassing or abusive purpose, or so as to damage or cause risk to our business, reputation, employees, subscribers, facilities, or to any person. Improper uses include, but are not limited to: (a) Violating any applicable law or regulation; (b) Posting or transmitting content you do not have the right to post or transmit; (c) Posting or transmitting content that infringes a third party's trademark, patent, trade secret, copyright, publicity, privacy, or other right; (d) Posting or transmitting content that is unlawful, untrue, stalking, harassing, libelous, defamatory, abusive, tortious, threatening, obscene, hateful, harmful or otherwise objectionable, as determined in our sole discretion; (e) Attempting to intercept, collect or store data about third parties without their knowledge or consent; (f) Deleting, tampering with or revising any material posted by any other person or entity; (g) Accessing, tampering with or using non-public areas of the Community, Pipefy's computer systems and network or any Pipefy website; (h) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (i) Attempting to access or search the Community, the Pipefy network or any Pipefy website with any engine, software, tool, agent, device or mechanism, other than the software and/or search agents provided by us or other generally available third party web browser; (j) Sending or attempting to send unsolicited messages, including without limitation, promotions or advertisements for products or services, “spam”, “chain mail” or “junk mail”; (k) Using or attempting to use the Community, the Pipefy network or any Pipefy website to send altered, deceptive or false source-identifying information; (l) Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising, or in any way making up, a part of the Community, the Pipefy network or any Pipefy website; (m) Interfering or attempting to interfere with the access of any user, host or network, including without limitation, sending a “virus” to the Community, the Pipefy network or any Pipefy website, overloading, “flooding,” “spamming,” “crashing,” or “mailbombing” the Community, the Pipefy network or any Pipefy website; (n) Impersonating or misrepresenting your affiliation with any person or entity; (o) Using the Community to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as “pyramid schemes”, “Ponzi schemes”, unregistered sales of securities, and securities fraud; or (p) Excessively high volume data transfers or bandwidth consumption, hosting of a web server, internet relay chat server or any other server, and non-traditional end user activities. If we suspect violations of any of the above, we may discontinue your access to the Community, the Pipefy network or any Pipefy website, institute legal action, and/or cooperate with law enforcement authorities in bringing legal proceedings against violators. You agree to reasonably cooperate with us in investigating suspected violations. Pipefy reserves the right to install, implement, manage and/or operate one or more software applications, monitoring programs, or other solutions designed to assist us in identifying and/or tracking activities that we consider to be illegal or violations of this Agreement, including, but not limited to, any of the activities described in this “Community Use” Section. We may, but are not obligated to, when necessary to mitigate risks, contain violations of these Terms, or for security and compliance reasons, remove, block, filter or restrict by any means any materials or information (including, but not limited to, emails) that we consider being actual or potential violations of the restrictions set forth in this Agreement, including, but not limited to, those activities described in this “Community Use” Section and any other activities that may subject Pipefy or its customers to harm or liability. Pipefy disclaims any and all liability for any failure on its part to prevent such materials or information from being transmitted through the Community. 1A. Minimum Age By registering for the Community, you represent that you are at least 18 years old and have the legal capacity to accept these Terms on your own behalf or on behalf of the company you represent. 2. Content Pipefy does not claim ownership of the materials you provide to Pipefy (including feedback and suggestions) or post, upload, input or submit to the Community (collectively "Submissions"). Pipefy may retain copies of materials as reasonably necessary to comply with legal or contractual obligations, resolve disputes, or protect its rights. By posting, uploading, inputting, providing or submitting your Submission you are hereby granting Pipefy, its affiliated companies, and necessary sublicensees a non-exclusive, worldwide, royalty-free, sublicensable license to use your Submission in connection with the operation of the Community and their businesses, including, without limitation, the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, reformat, and use your Submission, including in aggregated or de-identified form to operate, maintain, and improve Pipefy’s products and services, including artificial intelligence and machine learning features, without utilizing identifiable business data for general model training; and to publish your name in connection with your Submission. This license remains in effect for as long as the Submission remains posted in the Community, or as reasonably necessary thereafter to comply with legal or contractual obligations. No compensation will be paid with respect to the use of your Submission, as provided herein. Any promotional campaign involving prizes or gifts conducted through the Community will comply with applicable law, including, for campaigns directed at users domiciled in Brazil, prior authorization requirements under Law No. 5,768/1971 and applicable regulations of Brazil’s Secretaria de Prêmios e Apostas (SPA), where required. Participation in such campaigns does not, in itself, constitute any form of remuneration. Pipefy is under no obligation to post or use any Submission you may provide and may remove any Submission that violates these Terms, poses a risk to the Community, or as required by applicable law. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission, as described in this “Content” Section, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions. You further agree that Submissions shall not be considered confidential. 3. Content Disclaimer: Cautions and Restrictions Pipefy does not control, nor are we responsible or liable for, data, content, information services, or products (including software) that you access, download, or receive via the Community. We may, but do not have to, block Submissions or other information, transmissions, or access to certain information, services, products, or domains to protect us, our network, the public, or our users. Pipefy reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, if they violate these Terms or pose a risk to the Community. Pipefy does not control or endorse the content, messages or information found in any Submissions and, therefore, Pipefy specifically disclaims any liability with regard to the Submissions and any actions resulting from your participation in the Community. Managers and hosts are not authorized Pipefy spokespersons, and their views do not necessarily reflect those of Pipefy. We are not a publisher of third-party content accessed through the Community and are not responsible for the content, accuracy, timeliness or delivery of any Submissions, opinions, advice, statements, messages, services, graphics, data or any other information provided to or by third parties as accessible through the Community. However, Moderators may, at any time and at their discretion, delete or change any post made by members of the Community. 3A. Moderation Appeal If you believe that content you posted was removed, or that your account was suspended or restricted in error, you may request a review by contacting community@pipefy.com within 15 days of the action. Pipefy will review the request and respond within a reasonable timeframe. 4. Pipefy Employee Pipefy employees may participate in the Pipefy Community but are required to be identified by a Pipefy logo or badge. All Pipefy employees are subject to Pipefy's Code of Ethics and Conduct, as well as Pipefy's Privacy and Security policies when accessing, using, or participating in the Community. Except for Community Roles described below, Pipefy employees may not ask Community members for any personal information via a post in a community forum or via Private Message (PM). Pipefy employees are not authorized to access customer accounts in any capacity or for any reason. Except when acting expressly in an official Community role (such as Community Managers or Support Engineers), employees participating in the Community do not represent Pipefy's official position, and their personal views and opinions do not necessarily reflect those of the company. A Pipefy employee’s failure to comply with this Agreement, these Terms of Use, Code of Ethics and Conduct, as well as Pipefy's Privacy and Security policies will result in corrective action up to and including termination. 5. Community Roles Community roles and privileges are assigned at Pipefy's sole discretion and may be altered, suspended, or revoked at any time. Super User This role recognizes the most engaged members of the Pipefy Community, those who are highly active, demonstrate strong product knowledge, and consistently contribute constructively. Super Users may mark a response to a question as the correct solution, and their posts are not subject to automated spam detection filters, where enabled. Moderators Moderators have access to most, but not all, of the features available in the Community’s Control Environment. They may moderate content, suspend or ban users, and create and assign Post Fields, among other administrative functions. Community Managers & Administrators Community Managers and Administrators hold full administrative authority over the Pipefy Community. In addition to the features available to Moderators, Community Managers and Administrators exclusively have access to: Badges (which may be made accessible to other users via custom roles); Phrases (the ability to edit text on buttons, emails, and other Community elements); Third-Party Scripts (the ability to upload scripts or code to the Community); and the appearance menu, embeddable widgets, and Single Sign-On (SSO) settings. 6. Copyright and DMCA Notice If you believe that the material available in the Community or that resides in our system or network infringes on your or a third party's copyright, please notify us immediately through the email legal@pipefy.com. After receiving the notice, Pipefy will review the request and may remove or disable access to the infringing material in accordance with applicable copyright laws and the procedure provided under the DMCA. There are substantial penalties for sending false notices. It is Pipefy's policy, in appropriate circumstances and in its sole judgment, to suspend or terminate access to the Community by any user who is considered a repeated or flagrant copyright infringer. 7. Governing Law, Jurisdiction and Venue These Supplemental Terms of Use are subject to the same dispute resolution, disclaimers, exclusive remedy, and limitation of liability provisions set forth in Sections 13.3 and 13.4 of the Master Subscription Agreement, except as expressly provided otherwise herein. Accordingly: (i) the parties will first seek to resolve any dispute through good-faith amicable negotiation, as provided in Section 13.3 of the Master Subscription Agreement; and (ii) if the dispute is not resolved, these Supplemental Terms of Use will be governed by the laws of the State of California, USA, and subject to the exclusive jurisdiction of the courts of San Francisco County, California, USA, except that, if you are domiciled in Brazil, these Supplemental Terms of Use will be governed by Brazilian law and subject to the exclusive jurisdiction of the Foro Central da Comarca de Curitiba, State of Paraná, Brazil. If there is a conflict between these Supplemental Terms of Use for the Community-related Services and the Master Subscription Agreement, then these Supplemental Terms of Use take precedence with respect to matters relating to the Community-related Services. These Supplemental Terms of Use do not apply to or alter provisions relating to other Services not related to the Community. 7A. Brazilian Data Protection Law (LGPD) For Community members domiciled in Brazil, personal data collected through registration, posts, and platform usage is processed in accordance with Brazil’s General Data Protection Law (Lei Geral de Proteção de Dados Law No. 13,709/2018), as further detailed in Pipefy’s Privacy Policy, available at https://www.pipefy.com/legal-portal/privacy-policy/, and, where applicable, the Data Protection Agreement available at https://www.pipefy.com/legal-portal/annex-i-data-protection-agreement/. 7B. Community Platform Provider The Community is hosted and operated using a third-party community platform provider, engaged by Pipefy as a subprocessor for this purpose. A current list of subprocessors engaged in connection with the Community and other Pipefy Services is available at https://www.pipefy.com/legal-portal/sub-processors/.
