Supplemental Terms & Conditions for the Pipefy Community


Welcome to the Pipefy Community (“Community”).  You agree that by accessing the Community you agree to and are bound to these Supplemental Terms and Conditions and the Terms and Conditions  found at http://www.pipefy.com/community-terms-and-conditions (the “Master Subscription Agreement”) as well as Pipefy’s privacy policy found at https://www.pipefy.com/privacy-policy/.  

The Community is a part of the Services as defined in the Master Subscription Agreement.  By entering into these Supplemental Terms and Conditions, you are agreeing to a new Purchase Order for the Community related Services (as such terms are defined in the Master Subscription Agreement); however, there are no fees charged for the Community related Services. Pipefy reserves the right to change these terms and conditions at any time.


1. Community Use

The Community contains a communication forum designed to enable you to communicate about the resolution of issues regarding Pipefy products and services.  You agree to use the Community only to post, send, and receive messages and material that are appropriate and related to the purpose of the Community.  You agree that, when using the Community, you will not use or attempt to use the Community for any fraudulent, unlawful, harassing or abusive purpose, or so as to damage or cause risk to our business, reputation, employees, subscribers, facilities, or to any person.


Improper uses include, but are not limited to: (a) Violating any applicable law or regulation; (b) Posting or transmitting content you do not have the right to post or transmit; (c) Posting or transmitting content that infringes a third party's trademark, patent, trade secret, copyright, publicity, privacy, or other right; (d) Posting or transmitting content that is unlawful, untrue, stalking, harassing, libelous, defamatory, abusive, tortious, threatening, obscene, hateful, harmful or otherwise objectionable, as determined in our sole discretion; (e) Attempting to intercept, collect or store data about third parties without their knowledge or consent; (f) Deleting, tampering with or revising any material posted by any other person or entity; (g) Accessing, tampering with or using non-public areas of the Community, Pipefy's computer systems and network or any Pipefy website; (h) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (i) Attempting to access or search the Community, the Pipefy network or any Pipefy website with any engine, software, tool, agent, device or mechanism, other than the software and/or search agents provided by us or other generally available third party web browser; (j) Sending or attempting to send unsolicited messages, including without limitation, promotions or advertisements for products or services, "spam", "chain mail" or "junk mail"; (k) Using or attempting to use the Community, the Pipefy network or any Pipefy website to send altered, deceptive or false source-identifying information; (l) Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising, or in any way making up, a part of the Community, the Pipefy network or any Pipeft website; (m) Interfering or attempting to interfere with the access of any user, host or network, including without limitation, sending a "virus" to the Community, the Pipefy  network or any Pipefy website, overloading, "flooding," "spamming," "crashing," or "mailbombing" the Community, the Pipefy network or any Pipefy website; (n) Impersonating or misrepresenting your affiliation with any person or entity; (o) Using the Community to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes", "Ponzi schemes", unregistered sales of securities, and securities fraud; or (p) Excessively high volume data transfers or bandwidth consumption, hosting of a web server, internet relay chat server or any other server, and non-traditional end user activities.


If we suspect violations of any of the above, we may discontinue your access to the Community, the Pipefy network or any Pipefy website, institute legal action, and/or cooperate with law enforcement authorities in bringing legal proceedings against violators.  You agree to reasonably cooperate with us in investigating suspected violations.

 

Pipefy reserves the right to install, implement, manage and/or operate one or more software applications, monitoring programs, or other solutions designed to assist us in identifying and/or tracking activities that we consider to be illegal or violations of this Agreement, including, but not limited to, any of the activities described in this “Community Use” Section. We may, but are not obligated to, in our sole discretion, and without notice, remove, block, filter or restrict by any means any materials or information (including, but not limited to, emails) that we consider being actual or potential violations of the restrictions set forth in this Agreement, including, but not limited to, those activities described in this “Community Use” Section and any other activities that may subject Pipefy or its customers to harm or liability. Pipefy disclaims any and all liability for any failure on its part to prevent such materials or information from being transmitted through the Community.

2. Content

Pipefy does not claim ownership of the materials you provide to Pipefy (including feedback and suggestions) or post, upload, input or submit to the Community (collectively "Submissions"). Nevertheless, if you choose to remove any material produced by you, you must previously notify Pipefy, through the official communication channels of the Community. By posting, uploading, inputting, providing or submitting your Submission you are hereby granting Pipefy, its affiliated companies, and necessary sublicensees, permission to use your Submission in connection with the operation of the Community and their businesses, including, without limitation, the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.  No compensation will be paid with respect to the use of your Submission, as provided herein. Campaigns with gifts will not present any form of remuneration for participation in the program. Pipefy is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in Pipefy's sole discretion.


By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission, as described in this “Content” Section, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.  You further agree that Submissions shall not be considered confidential.


3. Content Disclaimer: Cautions and Restrictions

Pipefy does not control, nor are we responsible or liable for, data, content, information services, or products (including software) that you access, download, or receive via the Community. We may, but do not have to, block Submissions or other information, transmissions, or access to certain information, services, products, or domains to protect us, our network, the public, or our users. Pipefy reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, at Pipefy's sole discretion.


Pipefy does not control or endorse the content, messages or information found in any Submissions and, therefore, Pipefy specifically disclaims any liability with regard to the Submissions and any actions resulting from your participation in the Community.  Managers and hosts have not authorized Pipefy spokespersons, and their views do not necessarily reflect those of Pipefy.  We are not a publisher of third-party content accessed through the Community and are not responsible for the content, accuracy, timeliness or delivery of any Submissions, opinions, advice, statements, messages, services, graphics, data or any other information provided to or by third parties as accessible through the Community. However, Pipefy’s Moderators may, at any time and its discretion, delete or change any post made by members of the Community.


4. Pipefy Employee

Pipefy employees may participate in the Pipefy Community but are required to be identified by a Pipefy logo or badge.  All Pipefy employees are subject to Pipefy's Code of Ethics and Conduct, as well as Pipefy's Privacy and Security policies when accessing, using, or participating in the Community. Except for Community Roles described below, Pipefy employees may not ask Community members for any personal information via a post in a community forum or via Private Message (PM).  Pipefy employees are not authorized to access customer accounts in any capacity or for any reason.  Pipefy employees that participate in the Community do not represent Pipefy, may not claim to speak on behalf of Pipefy, and their views and opinions do not necessarily reflect those of Pipefy. A Pipefy employee’s failure to comply with this Agreement, these Terms of Use, Code of Ethics and Conduct, as well as Pipefy's Privacy and Security policies will result in corrective action up to and including termination.


5. Community Roles 

Super user

This role is for the heroes of your community. Those who are very active, have a lot of knowledge and the right attitude. With this role, they are able to mark responses in a question as to the correct solution. Also, their posts will not be touched by the spam detection (should this be activated in your community).


Moderators

Moderators have access to most of the features available in the Control Environment, but not to everything. They can moderate content, ban users, create and assign Post Fields, and much more. 


Community Managers & Administrators

As you probably would expect, Community Managers and Administrators have full power over a community. Besides the features available for Moderators, there are a number of features in the Control Environment which are exclusive for the Community Managers & Administrators:

  • Badges (can be made accessible to other users via custom roles)
  • Phrases (Ability to change the text of buttons, Emails, etc. on the Community)
  • Third-Party-Scripts (Option to upload scripts/code to the community)
  • Administrators have exclusive access to the appearance menu, the embeddable widgets as well as the SSI settings.


6. Digital Millennium Copyright Act (“DMCA”) Notice

If you believe that the material available in the Community or that resides in our system or network infringes on your or a third party's copyright, please notify us immediately through the email legal@pipefy.com. After receiving the notice, we may remove or disable access to any infringing material, as provided for in the DMCA. There are substantial penalties for sending false notices. It is Pipefy's policy, in appropriate circumstances and in its sole judgment, to suspend or terminate access to the Community by any user who is considered a repeated or flagrant copyright infringer.


7. Governing Law, Jurisdiction and Venue;

These Supplemental Terms of Use are governed by and construed and enforced by the laws of the State of Delaware and hereby incorporate, and are subject to, the same arbitration, disclaimers, exclusive remedy, limitations of liability, and other applicable provisions as in the Master Subscription Agreement, except as expressly provided otherwise.  If there is a conflict between these Supplemental Terms of Use for the Community related Services and the Master Subscription Agreement, then these Supplemental Terms of Use take precedence with respect to matters relating to the Community related Services.   These Supplemental Terms of Use do not apply to or alter provisions relating to other Services not related to the Community.
